1. Description of Services

Evoy World provides specialized content to registered users while traveling, including brief facts about landmarks. Users must independently visit landmarks and take photos with the Evoy World app to access and save this content. The app requires an internet connection, camera, and location services to function.

Different models are available: Beta (free), Evoy World Basic (free with limitations), Evoy World+ (€0.99/month), and In-App Purchases (€0.99/city). The availability and content of these models may change.

2. Registration, Acceptance of Terms of Use

Users must install the app and create an account to use Evoy World services. The account can be opened by individuals aged 16 or older. By creating an account, users agree to the TOS and app policies. The use of Evoy World does not guarantee specific success, and GXD is not liable for any resulting damages.

3. App Policies

Users must adhere to rules regarding prohibited content, discrimination, personal rights, copyright infringement, legal violations, dangerous behavior, encouragement of substance consumption, and immoral actions. Violations may result in account suspension or legal action.

4. Modification of Terms of Use and Scope of Services

We reserve the right to modify or discontinue the services and TOS at any time. Users will be notified of changes, and continued use of the app constitutes acceptance of the updated terms.

5. Evaluation and Further Use of User Data

We may collect and use user data to improve services, provide personalized content, and conduct marketing activities. By using the app, users consent to the collection and processing of their data as outlined in our Privacy Policy.

6. Usage Rights, Intellectual Property Rights

Users are granted a non-transferable, non-exclusive right to use Evoy World services. This right can be terminated according to the TOS provisions.

7. Prohibited Actions, Content Blocking

We may block access to content that violates app policies or laws. Prohibited actions include disassembling app software, disrupting app functionality, using the app for illegal activities, and commercial use without authorization.

8. Termination of Account by Evoy World

We may terminate user accounts for violations of the TOS, such as providing false information or breaching app policies.

9. Indemnification

Users agree to indemnify GXD against claims resulting from unlawful actions, including violations of intellectual property rights.

10. Disclaimer

We are not liable for disruptions caused by third-party services, misuse of user accounts, inaccuracies in app content, or damages from app use. Content is reviewed upon report but not monitored regularly.

11. Limitation of Liability

We are not liable for damages resulting from decisions based on app content or navigation data. Use of our services is at the user's own risk.

12. Other Provisions

German law applies, and jurisdiction is in Karlsruhe, Germany. Changes to the user agreement require written form, and oral agreements are not valid. Users can access the European Commission's online dispute resolution platform, but we are not obligated to participate in such proceedings. Invalid provisions will be replaced by legally compliant ones.
